This morning, I found this document, the Supreme Court of the state of Delaware 2022 annual report. All you need to know for our purposes here, we want the time from filing to disposition and for 2022, the average across all of the cases at the Supreme Court was 176.3 days. So instead of expecting some news on this in three months, like I said yesterday, now getting more information, I'm expecting something in roughly six months time, so apologies for any confusion. Tesla did come out and say they would appeal, but they could also just use that as leverage in a settlement.

Now, I don't think that's likely because of what I said on X about what Elon has said about not settling unjust cases against Tesla. But now that the plaintiffs' lawyers have something to lose to the tune of $345 million, Tesla could pay them a fraction of that, allow Elon to get paid and everyone moves on and those attorneys never have to work again. But if I had to guess, it seems more likely Tesla does appeal to the Delaware Supreme Court, which does have to hear this case. And sure, eventually this could make it to the US Supreme Court, but that court has no obligation to take the case.

And as you can see in this table in 2022, only 5.4% of the cases that were seen by the Supreme Court were actually reversed. That includes both for criminal and civil, which is not an encouraging statistic, but you could also argue that this Tesla case seems like it could be one of these minority cases. Now in the long run, this will be a blip on the radar for Tesla, no matter how it plays out, but if Elon and Tesla can't get the decision reversed, the cost to create a new compensation plan is likely going to be quite costly for Tesla. Which is wild because this lawsuit is supposed to be about protecting shareholders when in reality it's becoming very harmful to shareholders.

And it does not take a lawyer to see that this case clearly only exists as a payday for the plaintiff's attorneys and potentially as lawfare against Elon. But as always, if any community initiatives develop to support Tesla and Elon, I'll definitely let you know. A quick aside, the Secretary of State in Texas in June this year already signed the papers for Tesla reincorporating to Texas. Some people were saying that there's litigation pending that's challenging Tesla's reincorporation to Texas, but personally, I have not been able to find anything about that. In real quick, I don't do the personal drama, but just to clear up some facts here, so AJ on X was calling Gary Black a liar. What he pointed out was June earlier this year, Gary said I cannot see Judge McCormick trying a second time to overturn the will of the Tesla shareholders who again approved the vote. And then yesterday, Gary said as expected, Judge McCormick has again rejected Elon's 2018 comp plan. And if you stop there, you could certainly say that does not look great for Gary. However, Gary has come out and said he changed his mind about that. And if you go to his pinned tweet, you'll actually see a downside catalyst for Tesla. Judge McCormick likely to again reject Elon's 2018 comp plan. And that was well before the decision came in. So on this one, Gary clearly just changed his mind. He was not outright lying, as AJ said.

Tesla China is doing very well right now. We got the data for week nine of quarter four. It came in at 18,600 comparing that to the same weekend quarter three. That number was 14,400. So quarter over quarter, Tesla China is now up 5.85%. With four weeks left in the quarter, Tesla would have to average just over 15,525 per week to set a new quarterly record. In week nine of quarter four last year, that number was 17,400. Thus year over year, Tesla China is now up 14.26%. The model breakdown for the week, 7100 model three and 11,500 model Y. Heinrich Zane gave us another Tesla semi factory update. As you can see, they're making great progress with the exterior, but there's a new foundation area where some people had some questions. So you see this new foundation that's dug deeper than the rest of the factory and people were wondering what this area will be for. The main consensus and what I'm seeing from some other folks that have actually worked at places like Yigabra Lin is that this will be the area for the stamping of the semi. And if you look at this render on the far right, you'll see that section that has the raised ceiling, likely where that new foundation is. That's where the stamping machines will likely be, as that equipment is rather large. Tesla's model three long range has made it on car and drivers top 10 cars for 2025. They called it an excellent mainstream EV sedan. That's also a great deal. They said it's leaps and bounds better than before someone over at Tesla must be a reader. And in closing, after talking about the pricing, they said for a car as capable, satisfying and useful as this model three, it's an outstanding deal. And it makes one wonder why most other automakers are losing big money on much more expensive EVs. All I can say is if they'd been watching Electrified for the past few years, they would not be wondering. And check this out, I found a media kit for car and driver for 2024 and their monthly unique visitors. It's over 11.1 million. There's a report out there from Business Insider, so be extra careful with this one, but they're saying that Tesla has told Cybertruck production employees to stay home for December 3rd through the 5th. If this is true, it could be many things, production upgrades, line maintenance, or it could be they have excess capacity. Based on all available data, my guess would be one of the first two. Those timelines make sense for upgrades and or maintenance. But either way, they said employees will still be paid as usual.

Car news China has said that the Tesla China team has denied that the Cybertruck would be brought to China through official channels anytime soon, saying it has no plans to sell the model in the world's largest EV market. And remember earlier this year, Elon said getting Cybertruck rode illegal in China would be very difficult, but we could ship some prototypes over for display. China has plenty of different restrictions on pickups, including where they can actually go in different cities. So I don't think China is going to be high on Tesla's list for the rollout of the Cybertruck. A few months back, we talked about the iron ore miner Fortescue and how they're working to electrify their heavy duty mining truck fleet. Well, they just got some money from the Australian government and now they're going to develop a 6 megawatt fast charging unit. 6 megawatts is equivalent to 6000 kilowatts and if you divide that by 250 kilowatts for the average V3 charging speeds, that means this would be about 24 times faster than Tesla's V3 superchargers. The chargers are needed for the 1.9 megawatt hour batteries that drive the power systems. Fortescue said the 6 megawatt fast charger will be compatible with a wide range of battery electric heavy mining equipment. And that the units will be equipped with robotic connection options.

In my opinion, anytime the limits of what's possible are being pushed, it's certainly worth sharing. California having electric vehicle tax credits makes all the sense, but excluding Elon Musk and Tesla for probably political reasons is just foolish. The reality is Tesla is the biggest manufacturer of electric vehicles in California. The Inflation Reduction Act explicitly got rid of the caps on companies like Tesla so that they could produce more electric vehicles. And if you're looking just three days ago, the New York Times had a report that China is leading 1.7 million electric vehicles exporting around the world. We're way behind and we need to be producing more of these electric vehicles in the United States. So I don't think politics should interfere with manufacturing or with an issue of our national competitiveness. I mean, you can disagree with Elon Musk as I do on a number of issues and speak out about that, but don't target a company because of political views. Well, look, I mean, the governor and others are going to say this is to help the small manufacturers. The reality is that there is no clear rationale in my view that isn't colored by politics. I mean, when Biden didn't invite Elon Musk and and showered praise on Mary Barra as the visionary for electric vehicle revolution, that was just nonsense. And the country knew that. I mean, I know disrespect to Mary Barra, but come on, she was dragging her feet on electric vehicles and Tesla helped create the electric vehicle revolution with a grant from Obama. And people people hate that kind of politics. How refreshing is it to hear a politician not talking their book, not being partisan, but just speaking in logical sensibilities? I'm not sure how much influence Roe will have over Gavin Newsom, but this certainly won't hurt.

But the reason I'm so fixated on this is because I'm always thinking about what if there was a tire or a fender or a giant tree that was low to the ground and the cameras couldn't see. That would obviously be a disaster, so to see this performance without that front bumper camera to me is very encouraging.

And in case you missed it yesterday, Tesla is validating and testing the CyberCab all over Gigatexis. Joe Tett-Mayer caught some great drone footage of this in action. I believe it's being followed by the Model 3 that has cameras in the similar placement. Here's a quick chart showing us year to date sales and the comparison to last year for automakers in the United States. Year over year, through November, Acura is doing the worst down 10.1% and Mazda is doing the best up 18%. Tesla, as you can see, is not on the list. Not because they don't qualify or something, just because they don't report this data. But what I wanted to highlight was of all of these brands listed, only one, Acura is actually down year over year.

Recurrent has put out some research highlighting that by 2030, replacing an EV battery will cost less than fixing a gas engine. Goldman Sachs said that by 2026 battery prices should be $80 per kilowatt hour, about 50% of the 2023 price, which would be the prices having in just three years. And with most people buying used electric vehicles, they have plenty of questions about buying a used EV specifically around the battery. And they said as battery prices drop, replacement batteries get really affordable. Goldman Sachs put out a report in October saying that their estimated battery pack price in 2030 is $64 per kilowatt hour. And that number is at the pack level. And some other research firms like RMI are putting pack prices at under $50 per kilowatt hour by 2030. The main reasons for this, cheaper chemistries like LFP, becoming more prevalent and recycling, becoming a bigger part of the picture. Just an anecdote to keep in mind when you hear that argument.

The Cybertruck account on X has confirmed my speculation saying that the wrap and license plate customization is coming to other models in future updates. Here you're looking at the Sony Honda Mobility or SHM prototype that they're about to show off, which is a fully electric sedan at CES 2025. The joint venture is planning to make these cars at Honda's US plant and deliver them by 2026 starting with the US market and then Japan. The 2023 prototype had a total of 45 cameras and sensors for monitoring inside and outside the vehicle. They said the hardware or the car body is pretty much complete. We'll be working on the software until the last minute.
